Two boroughs, and on basements they take opposite positions
Weybridge is in Elmbridge. Virginia Water is in Runnymede. They are separate authorities with separate plans, and on the question that matters most for a large house they reach opposite answers.
In the Elmbridge Green Belt, Policy DM18(e) excludes a compliant basement from the volume and footprint calculation altogether, provided it is wholly subterranean, stays within the footprint of the existing building, generates no significant additional activity and is served only by discreet lightwells. Elmbridge's own supporting text concedes that a basement with little external evidence of its existence has only minimal impact on openness. In the Runnymede Green Belt, Policy EE14 says the reverse: a basement is still an addition to the size of the building and may therefore render it disproportionate or materially larger, and EE14 expressly captures basements, sunken areas, lightwells and changes to ground levels. Same national policy, opposite local outcome, five miles apart.
Neither borough has a basement policy for land outside the Green Belt, and neither has a Basement Impact Assessment requirement in policy. Elmbridge gives numbers in the Green Belt, 25 per cent on volume and footprint for extensions and 10 per cent for a replacement dwelling. Runnymede gives no numeric threshold at all under EE14, and the Green Belt SPD its Local Plan promised was never produced, so there is genuinely no local benchmark. That is a strong argument for pre application engagement on any substantial Virginia Water scheme rather than designing to an assumed figure.
Two private estates, each governed by its own Act of Parliament
The most prestigious addresses here are not controlled principally by planning at all. St George's Hill, Weybridge and the Wentworth Estate, Virginia Water are each governed by a private Act: the St. George's Hill, Weybridge, Estate Act 1990 and the Wentworth Estate Act 1964. These are not estate management schemes under section 19 of the Leasehold Reform Act 1967, and the distinction is not academic. A Local Act obligation is statutory, is registered as a local land charge and cannot be defeated by the usual restrictive covenant arguments about benefited land or lost deeds. The St George's Hill Act was promoted precisely because doubts had arisen about enforceability and some direct covenants were thought never to have been executed.
On St George's Hill the statutory obligations include detached houses only, a one acre minimum plot which can only be relaxed by an 85 per cent majority of the Residents Association's voting shares, and a tree provision requiring written consent before felling or lopping any tree of nine inches diameter measured two feet from the ground, with deemed consent after 28 days and disputes referred to an arbitrator appointed, failing agreement, by the President of the Royal Horticultural Society. Note that the Act's schedule contains no general plans approval obligation: the design approval requirement comes from direct covenants with the Residents Association and is plot specific, so it has to be checked on the individual title.
On Wentworth the Roads Committee is a statutory body corporate, and its own published position is that all building works and alterations require its consent, expressly including work that is permitted development, and independently of anything Runnymede does or does not require. The design code sets a plot ratio of 22 per cent of plot area over external walls at ground and first floor for Area A, excluding basements, ramps, balconies, lightwells and habitable loft space in most cases. Subdivision is barred outright. The published fee scale runs from £250 for gates and piers to £1,000 for a new dwelling with a basement, and a hydrogeological report or geotechnical survey is required for any basement construction. That private requirement is more onerous than anything in either Local Plan.
Working hours on the estates, and what is not designated
Wentworth publishes contractor rules that bear directly on programme and price: working 08:00 to 17:00 weekdays and 08:00 to 12:00 Saturdays, none on Sundays or Bank Holidays, with noisy groundworks including basement dig out and piling prohibited on Saturday mornings. Steel tracked vehicles are prohibited outright, five and six axle vehicles need express permission, verges are Committee property so no skips or storage, and verge damage must be repaired within a week. Any contractor pricing a Wentworth basement on standard hours will underprice the excavation phase.
Two points of designation are worth stating plainly because they are widely assumed and untrue. There is no St George's Hill conservation area, and there is no Wentworth or Virginia Water conservation area. Elmbridge has 26 conservation areas including Weybridge Town Centre, Weybridge Monument Green, Templemere and Brooklands; Runnymede has eight, none of them at Virginia Water. Neither borough has any Article 4 Direction removing householder permitted development rights, and Runnymede's own guidance states it has no plans to make one. What actually controls Wentworth is Green Belt, which covers around 79 per cent of Runnymede, the private covenant regime, and the Virginia Water Neighbourhood Plan made on 3 June 2026 with its mandatory Design Code. One caution on that plan: it records a community aspiration to restrict basements on the Wentworth Estate, but that was never carried into policy and has no force. Residents will raise it; it is not a rule.
